Thank you to our clients
I first would like to thank each and every one of our clients for your support of our firm. As Tonya was saying to me yesterday, we are very lucky to be in the business of helping people. It is because of our ability to assist you that we remain more passionate than ever about the mission of our firm. We pledge to continue to maintain a client-centric firm, in which we carefully select clients and directly focus on meeting the needs of every client.
Our firm handles litigation, transactions, and aggressive defense of government investigations.
Since our founding eight years ago, our firm handles both litigation and transactional matters. This allows us to provide our clients a breadth of legal services under one roof, and provide general counsel services to businesses of all sizes.
Furthermore, we are called upon to provide aggressive defense of individuals and businesses subject of federal and state investigations. We represent clients in such investigations on a nationwide basis. Also, we serve as local counsel to large private and public businesses that need assistance in the Atlanta area.
Our firm’s practice areas
We represent clients in business and contract law, real estate law, estate planning, probate, and criminal matters. Our practice specially focuses on defending businesses and individuals in government investigations and assisting clients purchase franchises and other businesses. Additionally, we provide a zealous defense of individuals arrested for drug possession and driving under the influence.
Our firm’s clientele features a broad spectrum of businesses, including: commercial construction contractors and subcontractors, an international restaurant franchisor, a Chinese-owned industrial materials company, a nationwide managed IT provider, health care service providers, technology firms, luxury travel and service providers, government contractors, media and advertising companies, health care providers, fitness center owners, nonprofit corporations, environmental control companies, restauranteurs, chefs, and bar owners, real estate developers, private equity firms, microlenders, and banks.
Our work in 2016 and future outlook
Litigation and Dispute Resolution
Our firm remained very busy on the litigation front in 2016. We successfully defended clients in lawsuits arising out of contracts and torts (essentially, civil wrongs). Furthermore, we aggressively sought dismissal of frivolous litigation at the earliest stage possible.
Additionally, we zealously represented our business clients and individuals by actively preserving and enforcing their legal rights. In many circumstances, this requires litigation. We never file a lawsuit without the intention of taking it to a jury trial and pride ourselves on filing motions and legal briefs that are well-researched and drafted. We have significant experience in filing lawsuits sounding in breach of contract, torts, and equitable remedies.
Our goal is to always resolve disputes in the most efficient way possible. However, there are circumstances which necessitate commencement of litigation in court or arbitration panels. We will continue to provide our clients aggressive representation in the most efficient manner possible.
Government Investigation Defense
Our firm continues to be sought after nationwide to provide detail-oriented and aggressive defense of clients subject of federal and state investigations. Our firm has experience in representing individuals in matters involving alleged violations of consumer protection laws, unfair business practices acts, the False Claims Act, white collar crimes, and other laws.
We remained quite busy in 2016 in this area, as we continue to see an increase in government investigations nationwide. As federal and state budgets face unprecedented shortfalls, governments are continually turning to civil enforcement penalties and fines to help replenish the coffers. Therefore, I expect that we will continue to see an increase in federal and state investigations in 2017.
Since initiation, our firm has defended clients subject of investigations in Georgia, North Carolina, Utah, Wyoming, Missouri, Florida, Pennsylvania, Vermont, New York, and California, and the U.S. Government.
We understand that being accused of wrongdoing by a government agency is a very stressful experience. We also understand that the matters can involve information of a very sensitive nature (such as intellectual property and proprietary information). Our experience allows us to quickly work with you and the government agency to best protect you and reach resolution in the most efficient manner possible.
I take inquiries regarding prospective clients subject of government investigation at all hours. Please contact me securely at email@example.com or (770) 427-1161 (forwarded to my mobile after hours) to discuss your matter.
Our firm remained active in designing, negotiating, and implementing business transactions for our clients, a trend that was thankfully unimpeded by the general election.
We assisted numerous clients in their business succession planning, through which we designed a process through which business owners can transition their business to family members or key employers when they desired to exit the business. Our goals in this process are to efficiently transition the business without court involvement and minimizing tax ramifications.
Additionally, we assisted entrepreneurs structure deals for new business ventures and assisted clients purchase new franchises with and without small business financing.
We remain optimistic that the increase in business deals and transacations will continue through 2017.
Estate Planning and Probate Matters
Our firm also remained very active in designing estate plans for individuals and families, through the use of Last Wills and Testaments, and various forms of trusts.
Protecting the needs of the disabled is a very personal issue for us. Accordingly, we assist families design and implement Special Needs Trusts, through which special needs individuals are able to receive contributions from family members (or damages awards arising out of personal injury matters) without losing government awarded benefits such as SSI or Medicaid.
Furthermore, we represent individuals as Personal Representatives of Estates and assist them with navigating the process of probating an estate. Given the amount of assets and/or debts, or the existence of a testamentary trust, this can be a complex task. Our experience and knowledge of this area of law provides us a unique ability to represent our clients.
Additionally, we represent individuals seeking to contest a probate proceeding (such as contesting the validity of a Will, the appointment of an Administrator, or filing an objection to a Petition for Year’s Support), and provide advice and counsel regarding all stages of the process.
Misdemeanor Criminal Matters
At the request of my clients, we expanded our practice in the last few years to include misdemeanor criminal matters and traffic violations. In 2016, we provided aggressive defense to individuals accused of drug violations, traffic violations (including reckless driving), and driving under the influence.
Being arrested for a crime is one of the most stressful experiences of your life, and the final disposition of a criminal matter can affect your remaining life. That is why we provide aggressive and detail-oriented representation in these matters. When you call our office, I will give you an honest assessment of your case. We make no moral judgments regarding the matter, and work to get you the best result possible.
These matters are aggressively enforced, and I predict that Georgia will continue to aggressively enforce marijuana laws well past 2017. While I hope that you will not be arrested for a DUI or drug possession crime, please call me immediately if you need assistance.
Thank you for your time and attention in reading this year’s report. Please stay in touch, and advise if I can be of assistance in any way. Please also feel free to stop by our Marietta office and say hello. You are always welcome, and Tonya and I always like reconnecting with our friends and clients and meeting new ones.
Good luck, keep the faith, and have a healthy and prosperous 2017.
2015 Annual Report
December 31, 2015
I am pleased to release my firm’s annual report, providing reflections from our work in 2015 and our firm’s vision as we look forward to 2016. Please note that the information contained herein does not constitute legal advice nor initiate an attorney-client relationship. Such a relationship can only commence after you enter into a retention contract with our firm. I welcome having a personal discussion with you to discuss how we can represent your interests. Please call me directly at 770-427-1161 to discuss your matter.
This year, I celebrated my ten-year anniversary of practicing law, and our firm celebrates its seventh anniversary in January. I thank God every day for the opportunity to practice law, and I truly enjoy my profession. It is a privilege to work with all of our clients.
My practice is focused on the areas of business law, estate planning, probate, and elder law, and real estate law. Our firm’s clientele features a diverse spectrum of small and medium sized businesses and includes technology firms, construction, demolition, and mechanical companies, media and advertising companies, health care providers, environmental control companies, restauranteurs, a nationwide franchisor, and a variety of franchisees in multiple industries.
I am pleased to report a significant increase in business transactional services performed in 2015, a reflection of an improving economy. In addition to assisting start-ups, we stayed quite busy with business succession planning, mergers, asset acquisitions, financing matters, contract negotiations, and divestments.
While we face uncertainties in the economy due to rising interest rates, sovereign debt crises (foreign and domestic), terrorism and conflict, and next year’s Presidential election, I remain hopeful that small and medium sized businesses will continue to have an environment to grow and thrive. I strongly believe it is important to elect leaders that will support small and medium-sized business growth, as we constitute the backbone of the economy.
We continue our aggressive defense representation of businesses subject of government investigation and/or litigation, primarily initiated by state attorneys general. To date, we have or are currently representing clients in investigations on a nationwide basis including the states of Georgia, North Carolina, Utah, Wyoming, Missouri, Florida, Pennsylvania, Vermont, New York, and California. Furthermore, I co-authored an article on representing businesses subject of investigation which was featured in an American Bar Association publication. Please contact me if I can assist in the defense of your business.
I anticipate that our firm’s services will be required in multiple investigations in 2016 and onward as states continue to seek revenue beyond its tax base in the form of fines and penalties generated from investigations.
The best protection against a governmental investigation is to ensure your businesses’ risk management and compliance departments are in order. I readily assist companies in ensuring their policies and procedures are updated. Please contact me to discuss further.
We continue to assist businesses navigate the burdensome and complex laws and regulations that affect their day to day businesses, particularly with regard to employee/independent contractor issues and the requirements associated with the Affordable Care Act. I expect continued involvement in these areas in 2016. Our estate planning and probate practice continued to thrive in 2015. I am pleased to announce that we will be providing extensive elder law services in 2016.
These services include incapacity and disability planning, Medicaid application assistance, and the representation of seniors who are victims of abuse. We are excited about this growth of our practice and welcome the opportunity to assist you or your parent.
Furthermore, we protect seniors by representing their interests in FINRA arbitrations in an effort to seek recovery of monies lost due to unsuitable financial investments at the hands of financial advisors. Please contact me to discuss how we may assist you.
We also continue to assist businesses and individuals in a variety of litigation matters, both in the courtroom and in arbitration tribunals. We also serve as local counsel for attorneys in other jurisdictions in addition to foreign corporations.
Much of our real estate work in 2015 relates to commercial real estate and lease acquisitions for our business clients. However, we continue to represent individuals and businesses in foreclosure, workout, and debt litigation matters. I anticipate that we may see increased work in this area in 2016 because of the expiration of short-term workouts that were made during the height of the financial crisis.
I am very pleased to have Tonya back with me at the office three days a week. You will have an opportunity to see her smiling face should you visit us at our Marietta office.
As we head into 2016, I wish you all good health and a prosperous new year. Please stay in touch.
